This website is maintained by Gregory Messer, the Trustee of the FKF Trust created in the chapter 11 case of In re FKF 3, LLC, which is currently pending before the Honorable Cecelia G. Morris in the United States Bankruptcy Court for the Southern District of New York.   The FKF Trust was created on May 2, 2011, pursuant to the terms of the First Amended Joint Plan of Liquidation for FKF 3, LLC, of the Debtor and Committee, which was confirmed by the Bankruptcy Court on April 18, 2011.  The FKF Trust is represented by its Trustee, Gregory Messer, and is governed by a board comprised of creditors of FKF 3, LLC, Kevin Romano (Chairperson), Kathryn Bareket, Ken Beck, Elias Josephs, Walter Klauser, Rabbi Ely J. Rosenzveig and Uri Sasson.  The goal of the FKF Trust and its Trustee and Members is to recover as much as possible for the benefit of creditors of FKF 3, LLC. 

The Committee created this website during the pendency of FKF 3, LLC’s bankruptcy case in furtherance of its duties under the Bankruptcy Code to provide its constituents (unsecured creditors) with access to information regarding the case.  The FKF Trustee will continue to maintain this website for the duration of the administration of the FKF Trust.  This website contains important case information and copies of critical documents filed with the Court and should help beneficiaries of the FKF Trust stay informed with respect to the recovery of their claims.  You will be able to track all public activity of the FKF Trust.  In addition, this website has a feature that allows you to submit written inquiries to the FKF Trustee.

Following an extensive investigation, on September 12, 2011, the FKF Trustee commenced a lawsuit against the Debtor’s former principals and certain for their family members and affiliates, seeking a recovery for the benefit of the Debtor’s victims.  The action is captioned Gregory Messer, as Trustee of the FKF Trust v. John Magee, et al., Adv. Pro. No. 11-09074 (CGM) (Bankr. S.D.N.Y. Sept. 12, 2011).  A copy of the complaint filed by the FKF Trustee is available on the tab to the left.  We will continue to post documents filed in that action on this site in order to keep creditors up to date on the status of the case. 

The FKF Trustee is and will continue to work hard to make sure that claims in this case are actively investigated and pursued, and that the most amount of money possible can be recovered for the benefit of FKF 3, LLC’s creditors.  If you have any questions, concerns, or wish to discuss these matters, the following is a list of the names and contact information of the key parties working to unravel FKF 3, LLC:
